The rental price includes: - The use of the chosen boat for a period of 8 hours or more, according to the agreements. - Mooring in home port - A crew made up of captain and hostess (not all the boat, please check on the page of the chosen one) - Soft drinks - Towels - Boat and occupant insurance

- Mooring in other Marinas - IVA 21% - APA 30% - Fuel consumption per l/h - Overnight on board

1. PAYMENT: reservations will only be made effective once you receive the confirmation by email; Any other amount pending payment must be paid on the day of shipment. 2. INSURANCE: the boats include accident insurance, the policy is available on board. 3. DURATION: the rental period will be 8 hours, starting at 10:00 a.m. and returning at the latest at 9:00 p.m. (July and August) and 8:00 p.m. other months. In case of spending the night on board, consult the particular conditions of the reservation. 4. CANCELLATIONS: A. Cancellations made up to 30 days before boarding will have 85% refund of the amount paid. B. No show: penalty of the total rental amount. C. Meteorological conditions: the company reserves the right to cancel the reservation if it is considered that the weather conditions make safe navigation impossible. Bad weather is considered: strong winds, rain, waves (swell). All changes/cancellations of the reservation must be communicated in writing via email to admin@xaloccharter.com 5. IMPOSSIBILITY OF DELIVERY OF THE BOAT BY THE LESSOR: If for reasons of breakdowns or for any cause beyond the control of the lessor, produced prior to the beginning of the lease, it is not possible to deliver the leased boat, a boat will be delivered of the same or similar characteristics. If this is not possible, and at the lessee's choice, a lower category boat will be delivered (with the consequent refund of the proportional difference in the rental price) or the full price paid up to that moment for the lease will be returned. 6. BREAKDOWNS TO THE BOAT DURING THE CONTRACT: If, due to a breakdown produced during the lease or other causes not attributable to the lessee, it is not possible to continue in the leased boat, the lessor will reimburse the amount proportional to the hours or days in which It has been possible to use the boat or it will provide a boat with similar characteristics. In no case will it give the right to extend the rental term. The lessee will not order any repair without first having indicated the fault to the lessor, who must grant their permission. The repair expenses will be borne by the lessor, except if the breakdowns occur as a result of negligence, ineptitude or deficient use of the boat by the lessee, and in this case they will be paid by the latter in its entirety, the lessor will consider it resolved this contract and will reserve the exercise of the claim for damages that the fault could cause. 7. CONDITIONS OF USE: The lessee is responsible for all acts of the persons indicated in the passenger list, which may not exceed the maximum capacity of the vessel in any case. In the event that children come on board, the lessee will be solely responsible for their safety, conduct and entertainment. It will be strictly prohibited to use the boat for the transport of merchandise, travelers other than those indicated in the previous point, the shipment of weapons, narcotics or any toxic or dangerous substance. The lessee undertakes to use the boat exclusively as a tourist or recreational charter, so in no case can it be used for commercial operations, professional fishing, transport, sports competitions, and any other incompatible with the destination of the boat. The lessee, as the only person responsible for the boat during the lease, will use it responsibly, abiding by the rules of the authorities with powers for this purpose, being solely and exclusively responsible for the consequences that will derive from non-compliance with them. 8. SUBCONTRACTING: The subletting or assignment of the boat by the lessee is totally prohibited. 9. PERSONAL PROPERTY: The lessor is not responsible for any damage or loss that may occur to the personal property of the passengers during the rental term. 10. DATA PROTECTION: The personal data contained in this contract are protected in accordance with Organic Law 15/1999, of December 13, on the Protection of Personal Data. These data may only be processed and transferred for the purposes of companies in charge of collection management, and for carrying out advertising campaigns for the lessor. 11. CLAIMS: Any claim that the lessee wishes to make must be made in writing at the time of returning the boat at the end of the contract. If it is not possible to do so in writing at that time, they will notify you verbally and will have a period of fifteen days to submit the complaint in writing. 12. JURISDICTION: For the solution of any dispute, the parties submit to the Administrative Authorities and Courts of Ibiza, the relationship between them being governed by Spanish Law. Once this contract has been read with its particular and general conditions contained therein, in proof of conformity it is signed in duplicate and for a single purpose, the Lessee and Landlord, as contracting parties, and said contract can be processed by email. The signed copies or originals will be considered valid and binding for the parties.
